Any person (“the Client”) participating in services offered by Excel Tennis Pty Ltd (“Excel Tennis”) acknowledges and agrees to the following:
a. Medical Advice and Disclosure
The Client is responsible for consulting their medical practitioner before participating in any physical activity. The Client must inform Excel Tennis in writing of any medical or other condition that may affect their ability to participate safely and update Excel Tennis of any changes to their health status.
b. Assumption of Risk
Participation in physical activity carries inherent risks. By participating, the Client voluntarily assumes all risks associated with injury or loss except where prohibited by law.
c. Medical Responsibility
It is the Client’s responsibility to seek medical clearance prior to participation. Excel Tennis staff are not medical professionals and are not responsible for diagnosing or treating medical conditions.
d. Physical Contact
Some physical contact may occur between coaches and participants as part of instruction or safety protocols. The Client consents to such contact where appropriate and necessary.
e. Property Damage
The Client is responsible for any damage to facilities or equipment caused by wilful or negligent actions.
f. Release of Liability
To the extent permitted by law, the Client releases Excel Tennis, its employees, agents, and contractors from all liability arising from participation in any program or use of facilities, except in cases of gross negligence or breach of statutory duty.
11. Prohibited Uses
You may not use this site or our services for:
- unlawful or fraudulent purposes;
- infringing on intellectual property rights;
- harassing, defaming, or discriminating against others;
- spreading harmful software or code;
- collecting personal information of others without consent;
